The UK EU Family Permit is part of the UK's immigration system for family members of EU, EEA, or Swiss citizens who were living in the UK by 31 December 2020. It's designed to allow eligible family members to join or accompany their EU relative in the UK.

Here’s a summary of the key requirements:


✅ Eligibility Criteria

To qualify, you must:


  1. Be a family member of an EU, EEA, or Swiss citizen who was living in the UK before 31 December 2020 under the EU Settlement Scheme (EUSS).
     
  2. Relationship types that qualify:
     
    • Spouse or civil partner
       
    • Durable (unmarried) partner (with evidence of a lasting relationship)
       
    • Child or grandchild under 21 (or dependent if older)
       
    • Dependent parent or grandparent
       

  1. The EU citizen ('sponsor') must either:
     
    • Have pre-settled or settled status under the EU Settlement Scheme (EUSS), or
       
    • Be eligible for EUSS but not yet applied (if still within the UK)
       

  1. The relationship must have existed by 31 December 2020 (for most categories).
     

📅 Application Deadlines


  • The EU Settlement Scheme Family Permit is still open after Brexit, but it’s meant for those with relationships formed before 31 December 2020.
     
  • It must be used to enter the UK within 6 months of issue.

✅ Eligibility Criteria

You can apply if you meet all of the following:


  • Nationality: Must be a citizen of a Commonwealth country, or one of: British Overseas citizen, British Overseas Territories citizen, British National (Overseas), or citizen of Zimbabwe
     
  • Age: At least 17 at the time of your intended arrival .
     
  • Ancestral Link: You must have a grandparent born in:
     
    • the UK, Channel Islands, or Isle of Man
       
    • or in Ireland before 31 March 1922
       
    • or on a UK-registered ship or aircraft 


Note: ancestry cannot be claimed through step‑parents
 

  • Work Intent: You must show the ability and intent to work in the UK (part‑time, full‑time, employed, self‑employed or voluntary), even if you don’t have a job offer yet 


  • Financial Requirements: You need to show you can support and accommodate yourself (and any dependants) without access to public funds. There’s no fixed minimum, but bank statements or credible third-party support suffice. Evidence should be dated within 31 days of application .
     

🛂 Application Basics

  • Apply from outside the UK, up to 3 months before your intended travel date
     
  • Processing time: Usually a decision within 3 weeks for applications made overseas; inside the UK, extensions take up to 8 weeks

     

📅 Duration, Rights & Path to Settlement


  • Duration: A 5‑year initial visa, with unrestricted work, study, volunteer and self‑employment rights
     
  • Dependants: Eligible partner and children under 18 can accompany you (they also get work/study rights)
     
  • No access to public funds: You cannot claim means-tested benefits during your stay

General Requirements

To be legally valid in the UK, a will must meet specific legal requirements under the Wills Act 1837 (as amended). Here are the key requirements:


✅ 1. Age

  • The person making the will (the testator) must be 18 years or older.
     

✅ 2. Mental Capacity

  • The testator must have “testamentary capacity”, meaning they:
     
    • Understand they are making a will and what a will does
       
    • Understand the extent of their estate (assets and liabilities)
       
    • Recognise the people who might reasonably expect to benefit
       
    • Are not affected by any mental illness or undue influence
       

✅ 3. Voluntary

  • The will must be made voluntarily, without pressure or coercion from others.
     

✅ 4. In Writing

  • The will must be in written form (typed or handwritten — not oral).
     

✅ 5. Signature

  • The testator must sign the will at the endof the document.
     

✅ 6. Witnesses

  • The signature must be made or acknowledged in the presence of two witnesses:
     
    • Both witnesses must be present at the same time
       
    • They must also sign the will in the testator’s presence
       
    • Witnesses must not be beneficiaries (or married to beneficiaries), or they risk losing their inheritance
       

✅ 7. Date

  • Although not legally required, it's strongly recommended to date the willto confirm it's the latest version.
     

🛑 Optional but Important

  • Executor appointment: Naming one or more executors to carry out the terms of the will
     
  • Revoking previous wills: Including a clause revoking any earlier wills or codicils

Here’s a list of important UK case law relating to wills — covering formation, capacity, undue influence, interpretation, and execution. I’ve included key facts and principles so they’re actually useful in practice.


1. Banks v Goodfellow (1870) LR 5 QB 549

  • Principle: Established the test for testamentary capacity.
  • Test: The testator must:
     
    1. Understand the nature of making a will and its effects.
    2. Understand the extent of their property.
    3. Comprehend and appreciate the claims to which they ought to give effect.
    4. Not be affected by any disorder of the mind influencing their dispositions.


2. Gill v Woodall [2010] EWCA Civ 1430

  • Principle: Court can set aside a will if the terms do not reflect the testator’s true intentions, especially where there is undue influence or a mistake.
  • Point: Raises the bar for proving undue influence — it requires coercion, not mere persuasion.

3. Re Key [2010] EWHC 408 (Ch)

  • Principle: Testamentary capacity can be affected by grief and bereavement.
  • Facts: Husband made will shortly after wife’s death; found to lack capacity due to impaired mental state.

4. Marley v Rawlings [2014] UKSC 2

  • Principle: Rectification of wills under s.20 Administration of Justice Act 1982.
  • Facts: Husband and wife accidentally signed each other’s wills. Court rectified them to reflect intentions.

5. Ilott v The Blue Cross & Others [2017] UKSC 17

  • Principle: Limits on the Inheritance (Provision for Family and Dependants) Act 1975.
  • Facts: Estranged adult child successfully claimed reasonable provision, but SC reduced award.

6. Edwards v Edwards [2007] WTLR 1387

  • Principle: Strong illustration of undue influence — coercion must overpower free will.

7. Re Edwards [2007] EWHC 1119 (Ch)

  • Principle: Burden of proof in undue influence claims rests on the person alleging it.

8. Re T (Adult: Refusal of Medical Treatment) [1992] 4 All ER 649

  • Relevance: While not directly about wills, it’s often cited on undue influence and mental capacity.

9. Simon v Byford [2014] EWCA Civ 280

  • Principle: Testamentary capacity is judged at the time of execution, not later deterioration.

  • Principle: Mistakes in execution can invalidate a will if formalities under s.9 Wills Act 1837 aren’t met.
